1. Terms

By accessing this Referee Courses [school], you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
      1. modify or copy the materials;
      2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
      3. attempt to decompile or reverse engineer any software contained on the School’s web site;
      4. remove any copyright or other proprietary notations from the materials; or
      5. transfer the materials to another person or 'mirror' the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Educational Purpose; No Certification or Placement Guarantee

The courses, materials, and content provided through this School ("Courses") are for educational and training purposes only. Completion of any Course does not guarantee, and should not be construed as:

  • Certification, licensure, or registration by any state high school athletic association, national governing body, conference, or assigning authority;
  • Eligibility to officiate at any particular level of competition;
  • Employment, assignment, advancement, or any officiating opportunity of any kind.

Rules, mechanics, and judgment guidance presented in Course materials reflect general practice at the time of publication and may not match the current rulebook, mechanics manual, or interpretations of your state association, conference, or assigning body. You are solely responsible for confirming current rules and requirements with your governing body before applying anything learned in a Course to an actual contest. In the event of any conflict between Course content and your governing body's rules, your governing body's rules control.

4. No Liability for On-Field Decisions

The School is not responsible or liable for any decision, call, judgment, action, or omission made by any user while officiating, whether or not related to Course content. This includes, without limitation, claims arising from disputed calls, contest outcomes, player or spectator injury, or disciplinary action by a governing body. Your use of Course content in any officiating capacity is entirely at your own risk and discretion.

5. Indemnification

You agree to defend, indemnify, and hold harmless the School, Referee Enterprises Inc., its officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  1. Your access to or use of the School's website or Course materials;
  2. Your violation of these Terms of Use;
  3. Any officiating decision, action, or conduct by you, whether or not informed by Course content;
  4. Your violation of any third-party right, including rights of any governing body, league, or association.

6. Dispute Resolution; Arbitration; Class Action Waiver

Any dispute arising out of or relating to these Terms of Use or your use of the School's website shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, conducted in [Racine County, Wisconsin], rather than in court, except that either party may bring an individual action in small claims court. You and the School each waive any right to a jury trial and to participate in a class action, collective action, or representative proceeding. This arbitration agreement survives termination of your use of the site.

7. Eligibility; Minors

This website and its Courses are intended for users age 13 and older. If you are under the age of 18, you may use this site only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. The School does not knowingly collect personal information from children under 13 in violation of applicable law.

8. Payment, Subscription, and Refund Terms

  1. Billing. Course fees are charged at the time of purchase or, for subscription products, on the recurring billing date you agreed to at signup.
  2. Auto-Renewal. Subscriptions renew automatically at the then-current price unless cancelled prior to the renewal date. You may cancel at any time through [account settings/contact method]; cancellation takes effect at the end of the current billing period.
  3. Refunds. Course purchases are refundable within 7 days of purchase if less than 25% of the Course has been completed. Subscription fees are non-refundable for partial billing periods.
  4. Chargebacks. Initiating a credit card chargeback without first contacting the School to resolve a billing dispute may result in suspension of your account.

9. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify the School immediately of any unauthorized use. The School is not liable for any loss arising from your failure to safeguard your login information.

10. Severability; Entire Agreement

If any provision of these Terms of Use is found unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the School regarding use of the website.

11. Disclaimer

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

12. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

16. Governing Law

Any claim relating to the School's website or these Terms of Use shall be governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions, and subject to the arbitration provision above.
